John Glengarry, partner at Buddle Findlay, was interviewed by the NBR. John discusses the end of a two decade battle over a registered trade mark between prominent clothing brand Lacoste and Singapore clothing company Crocodile International. Lacoste hadn't used the registered mark but had used broadly similar marks. The Supreme Court decided that Lacoste's use was not enough to maintain the registered mark and went on to say they didn't have a residual discretion to allow the mark to remain on the register nevertheless. John sees the decision bring certainty to the law on the use issue and change on the discretion issue.
